Minnesota Statutes Β§ 62Q.47 requires health plans that cover mental health and substance use disorder treatment to apply the same cost-sharing, treatment limits, and prior-authorization standards they use for medical and surgical benefits β no higher copay, no tighter visit cap, no extra approval step that a comparable physical health service would not face. Minnesota plans are also subject to the federal Mental Health Parity and Addiction Equity Act (MHPAEA). If a mental health benefit is being restricted in a way an equivalent medical benefit would not be, you have the right to appeal and to request the medical necessity criteria behind the denial. Complaints go to the Minnesota Department of Commerce for insurance company plans, and to the Minnesota Department of Health for HMO plans.
